Case of the YEAR 2009
I was looking back at my victories of 2009, trying to decide the case of the Year, and there were at least 3 or 4 possibilities, some of whom have already been mentioned both in this blog and on my web site. But the winner has to be:
My client was arrested on his motorcycle in Hall County for speeding 84 in a 55 mph zone. The arresting officer was one of Hall County’s top gun DUI officers. In fact he had only lost one jury trial before this one.
There was a video of the arrest. My client supposedly failed all three field sobriety tests, was arrested then refused the breath test at the jail. My client’s speech was not slurred nor was he unsteady, except in one portion of the walk and turn test.
At trial the officer was the only witness. Using the video, I was able to successfully cross examine the officer and was able to get the officer to admit: He failed to administer the field tests correctly, that my client was capable of handling his motorcycle safely, and that my client’s physical appearance did not indicate alcohol impairment.
The jury returned a verdict of not guilty in about thirty minutes! Was my client happy? See below:
