DUI consequences: 2nd DUI

One of the most common questons I get is, “What happens if I am convicted of a 2nd DUI?”
In Georgia the minimum sentence on a 2nd DUI conviction in 10 years that the Court can give is:
12 months probation;
$600 fine plus surcharges;
72 hours in jail;
240 hours community service;
alcohol and drug evaluation and completion of any treatment recommended;
risk reduction (DUI school);
interlock device;
tag forfeiture on any cars titled in your name;
photo fee to have your picture in the newspaper;

This is the minimum;Most courts give more jail time and higher fines, depending on whether the DUI is in Atlanta, Gwinnett County, Duluth or wherever;
In addition, on a 2nd DUI in 5 years, you lose your Georgia license for 3 years, with the first 12 months no driving; next 6 months you can get a limited permit with the interlock device and proof of completion of the alcohol program; then after that you are eligible to get your license reinstated once you pay the reinstatment fee.
