Memorial Day Driver’s Alert!

Saturday, May 23rd, 2009

According to today’s AJC, Gwinnett police will be enforcing the “move over” law on I-85 beginning tonight at 11 p.m. This law is actually a subterfuge used by cops to pull over drivers as part of a fishing expedition to search for DUI drivers. The law requires a driver to move over into the next lane, if possible, when approaching a stationary emergency vehicle with its lights flashing. This creates a very subjective situation where all the officer has to say to justify the stop is that, in his opinion, the driver did not move over or slow down. Be careful this Memorial Day weekend!

Big Brother is Right Behind You

Friday, May 22nd, 2009

Did you know that law enforcement now has a new tool to use in their various “wars”? Alpharetta and Sandy Springs Georgia police departments now have license plate readers, which can scan up to 18 to 20 tags a second, detecting the ones which would give the police reason to stop. (more…)

Senior Citizen Driving Part 2: Warning Signs

Monday, May 18th, 2009

If you wonder whether a senior is finding driving more difficult, watch for the following sigs of unsafe driving:

1. Abrupt braking or acceleration;
2. Finding unexplained dents or scrapes on the car;
3. Trouble reading signs;
4. Trouble moving the foot from gas pedal to brake, or confusing the 2 pedals;
5. Getting lost more often;
6. Trouble paying attention to signals, road signs, pavement markings, or pedestrians
7. Increased tickets or warnings;

In my mother’s situation, I did start to notice a couple of dents, which she could not explain; she also received two citations in the same week for stopping on a railroad track! Also, she locked herself out of the car on more than one occasion, and while following her, I began to notice that she would go really slow, then unexpectedly would speed up!

A Brilliant Solution

Sunday, May 17th, 2009

I just finished reading ” A Brillian Solution” by Carol Berkin. This book takes a look at the how we got  our Constitution. I must admit that as a native of the South, my Civil War knowledge far outweighs my knowledge of the Revolutionary War, and then the subsequent formation of out fledgling country. This book reminded me that the “United States” was not so United after independence from Great Britain. (more…)

A rich Norwegian has been ordered to pay a 700,000 kroner ($109,000) fine after driving his car 400 yards while drunk. Police stopped the 49-year-old man in October near the airport for southern Norway’s Kristiansand. Tests showed he had a blood alcohol content of .188 percent. Norway’s maximum is .02 percent. Case of Month May 2009

Tuesday, May 12th, 2009

The case of the month shows us just how easy it can be to get arrested for DUI these days. My client had been at his cousin’s house watching the Georgia football game; he had consumed 4 beers over a 3 hour tme sapn; On the way home he decided to stop by the local fast food restaurant. This restaurant is next to a local sport bar; several people were at the sport bar drinking and apparently had allowed their children to run wild in  the dark parking lot. (according to witnesses at the scene) (more…)

For years, DWI defense attorneys in Minnesota have been requesting access to the computer source code used in breath testing equipment during drunk driving arrests. On Thursday, the state Supreme Court issued an opinion on whether the code could become evidence in a DWI case. (more…)

Senior Citizen Driving Part 1: Risk Factors of Aging that affect Driving

Monday, May 4th, 2009

In conjunction with Mother’s Day and Father’s Day, I thought I would explore the world of senior driving. I have personally been involved in tragic events with accidents involving senior in laws, and have had to ask my mother to stop driving. Deciding when to take away a senior’s car is extremely difficult. Knowing that a senior should not be driving helps, but it still doesn’t make it any easier. Eveyone ages differently, but there are some key risk factors that affect senior drivers: (more…)
