Case of Month April 2010

This month’s case of the month is not one of my cases; it comes from the Georgia Supreme Court; it emphasizes how, on even a traffic case, your Constitutional rights are so very important. The case is Sentinel v. Harrelson and was decided in March, 2010. Ms Harrelson had represented herself; when she pled guilty, the judge had her sign a “waiver of rights” form, but did not take the time to make sure she knew what rights she was waiving. She hired a lawyer who filed a habeas corpus action seeking to withdraw the guilty plea. Georgia law requires that habeas actions be filed within 180 days of the plea. One of the areas I specialize in are habeas actions. If you have pled guilty to a traffic ticket and are now having second thoughts call me!

Case of the Month March 2010

This month’s case shows the importantance of having an experienced DUI lawyer defending you. My client was originally stopped for weaving and suspected of alcohol impairment. The cop administered a couple of field evaluations, then had my client blow into the alco sensor, giving a reading of .05. (more…)

Another Win for mrgadui!

This was a good win. Client was working on a friend’s car; he lives on a dirt road, and was driving the car, when the cops were called to the scene on a “suspicious” vehicle; cops saw NO traffic violation; no field tests, no breath test; cop tried to suspend my client’s license for a year because of refusing to take the breath test; I continued the license hearing long enough to convince the prosecutor that this was not a DUI; should have seen cop’s face when he found out his “iron clad” DUI was really NOT!
This is what my client said:
“When I was arrested for a DUI, I didn’t know what to do; I was scared, embarrassed, and definitely unsure about how it would play out. Case of the Month September 2009

Last week my client received a not guilty jury verdict on a DUI; client was traveling 89 mph in a 55mph on a motorcycle; although his speech was not slurred and his walk was normal; the officer said he smelled alcohol on my client’s breath, and my client “failed the 3 standard field tests; client refused all breath tests. At trial I was able to show that the field sobriety tests should be invalid because the officer failed to administer them according to his training. The jury returned a verdict of not guilty in 30 minutes, and later told me that without my cross exam of the officer, they would have convicted my client. This month’s Case of the Month shows just how very careful you have to be if you are on probation. Probation allows a person to keep from going to jail, but as a condition of not going to jail, the probationer must do certain things, including not violating any other laws, including the DUI laws. When people think of DUI, they normally think of driving while impaired due to alcohol. However, “DUI” can also mean driving while under the influence of drugs, of the legal and non legal variety. This month’s Case of the Month deals with driving while under the influence of prescription drugs. Many prescription drugs come with the warning “do not drive” while taking the drug. A person in Georgia is DUI due to prescription drugs when they are “rendered incapable of driving safely as a result of the consumption of the drug.” (more…)
